HUMANITARIAN INTERVENTION AND HUMAN RIGHTS/

We propose a UN Charter amendment to permit such intervention /humanitarian/ but restricting it to cases that in the judgement of a reformed Security Council constitute a violation of the security of people so gross and extreme that it requires an international response on humanitarian grounds. There should be a new ‘Right of Petition’ for non-state actors to bring situations massively endangering the security of people within states to the attention of the Security Council.
DHDR Article 8. 6 Where a State or insurgent fails to provide humanitarian assistance to internally displaced people or refugees, other States have a collective duty to support appropriate intervention to provide such assistance. The United Nations Security Council, under the United Nations Charter, has primary responsibility in such instances. Regional or sub-regional entities endowed with necessary powers have a duty to play a role in their respective regions and should be encouraged and empowered to do so by the global community.
HAPJ 33. Strengthen Mechanisms for
Humanitarian Intervention In order to help avoid future acts of genocide and
gross violations of human rights, it is necessary to develop mechanisms that
will allow for humanitarian intervention to protect the lives of people in danger.
HAPJ (themes): The Hague Appeal demands the speedy and effective
intervention of humanitarian forces, subject to the prescriptions of the United
Nations Charter, when civilians are threatened by genocide, war crimes, crimes
against humanity and extreme national disasters.
